May 24, 2008 - I'm more than a mere "skeptic." I've been involved in direct sales and marketing for 35+ years and I UNDERSTAND the laws as they apply to business opportunities. It doesn't really matter what you think -- gifting schemes (ALL of them) are thinly-disguised chain letters or pyramid schemes and state after state are going after them and closing them down.

Go to your search engine and type in "illegal gifting program" or "gifting program law". Or just keep taking the word of the folks who PROFIT from sucking you into it.

Stick to what you know, which I'd like to point out to you, is NOT EVERYTHING. A) all Cash Gifting systems do not function like a pyramid. ITS TRUE. Do some research.. Law is a very technical institution and cases are dismissed due to technicalities all the time. B) Did you know that laws and amendments can vary between states?

May 24, 2008 - CONT- Which explains why its now legal for two people of the same sex, to marry in California and now where else and it also explains why the only thing I found after Googling your quoted "gifting program law", said "Colorado Department of Law" (meaning it's COLORADO law) and it was from 2001. 8 years ago. May 24, 2008 - If you keep digging there are dozens. Virtually every state considers gifting programs as pyramids OR chains (a chain is what so many are now hailing as a "legal" modification). And FTC law also prohibits them. That makes it national. Oh -- wonder why none use the U.S. postal system? It's because gifting programs violate postal laws and constitute MAIL FRAUD. I'm not sure who's hard-headed here. I have NOTHING to gain telling you this.

Jun 3, 2008 - Great point, iamonlinew...all the so-called "evidence" that gifting programs are legal comes from people -- surprise, surprise -- who are involved in one and inviting you to "gift." I don't participate or run a gifting program and never would. And I make plenty of money other ways. As I said before -- I stand to gain nothing from this conversation other than saving as many people as possible from being misled into a felony.

Jun 12, 2008 - There are no GOOD pyramid schemes. They are ALL illegal. So are chain letters. The FTC and MOST attorneys general and the FTC consider gifting programs as either pyramids OR chains. Chains cover the "one-up" argument. The tax code has NOTHING to do with leaglizing anything. If you sell pot for a living you owe taxes on your profits. And -- sorry -- gifting to receive profits is NOT considered a "gift" under IRS law, either.

A person starting today can easily generate more money than someone that's been in a year. Copy cat programs in the past were closed because of this illegal structure, which we are NOT.

And making sure you get paid. That has nothing to do with legalizing what they do. Try again. The FTC, Attorneys General, Postal Inspectors ALL consider cash gifting programs as major felonies -- so apparently you are engaged in a crime to pay down your loans.

The IRS says: "You make a gift if you give property (including money), or the use of or income from property, WITHOUT EXPECTING TO RECEIVE SOMETHING of at least equal value in return." ..which directly contradicts your statement and the entire "Cash Gifting" idea, since everyone involved gave an initial gift expecting to get MORE money later.

It has NOTHING to do with taxation of the proceeds. It has to do with the fact that they are nothing more than thinly-disguised chain letters or pyramid schemes.
